Update review Privacy Shield23-10-2018
Last week, the second annual review of the EU-US Privacy Shield took place in Brussels. A crisis seems (for now) averted.
In the joint press release of 19 October 2018, the EU and US emphasized that the increase in companies that had joined the Privacy Shield last year, illustrates the importance of this mechanism for transatlantic data protection. Although the EU hinted at suspension or even termination of the Privacy Shield this summer (see our article of 16 October 2018 for more information), the press release demonstrates that the US managed to avert a crisis with the appointment of an Ombudsperson and three members to the Privacy and Civil Liberties Oversight Board.
The full report of the European Commission on the functioning of the Privacy Shield is expected by the end of this year. However, it is not unlikely that the European Data Protection Board (formerly the Article 29 Working Party) will release its own -more critical- report.
